TechFlame reports that the Trump administration on Wednesday asked the Supreme Court to quickly decide whether he has the right to levy broad tariffs under a law designed specifically for emergency use, according to NBC News.
According to the documents, the Department of Justice is appealing an August 29 ruling by the US Federal Circuit Court of Appeals, which alleges that Trump has exceeded his powers. These documents, submitted by the Ministry of Justice and challengers, have yet to be formally filed by the Supreme Court. Liberal Justice Center attorney Jeffrey Schwab, who represents businesses challenging tariffs, said in a statement that he believes the court will rule against the president.
The Government has submitted two documents: one is an appeal and the other is a motion to speed up the trial. In the latter, federal attorney General D. John Saul asked the justices to speed up the trial so that oral arguments could be held as early as the first week of November. This means the Supreme Court must decide whether to accept the case by next week. A spokesperson for the Liberal Justice Center said the challengers had agreed to this schedule.
There are also reports that the Supreme Court will accept the case and may decide in the summer of 2026.
